Terms Of Service

I understand and agree to the following:

1. The hosting included in your package begins the day of the email confirmation that includes my username and password. If you wish to continue after the term of Free Hosting (3, 6 or 12 months) is up, or would like to receive a rate chart, please contact us at: hosting@fpworld.com)

2. That FP World does not allow any websites they deem to be inappropriate or objectionable. This is including, but not limited to:

   1. Any site with adult-oriented content, including but not limited to any pornographic or sexually explicit material. FP World is required by law, to notify law enforcement agencies when it becomes aware of the presence of child pornography on, or being transmitted through, FP World's network.

   2. any material that is unlawful, threatening, abusive, malicious, defamatory, obscene, blasphemous, profane or otherwise objectionable in any way.

   3. any material containing a virus or other hostile computer program.

   4. any material which constitutes, or encourages the commission of, a criminal offence

   5. ...or which infringes on any patent, trade mark, design right, copyright or any other intellectual property right or similar rights of any person which may subsist under the laws of any jurisdiction.

3. NO streaming audio OR video is allowed. We do not offer these accounts because of bandwidth limitations. If you need these services, please contact us and we will refer you to a provider of this type of service.

4. You may not store on our servers:

   1. Illegal Material - This includes copyrighted works, commercial audio, video, or music files, and any material in violation of any U.S. or Local regulation.

   2. Adult Material - Includes all pornography, erotic images, or otherwise lewd or obscene content. The designation of "adult material" is left entirely to the discretion of FP World. Also includes any sites which provide "links to" information about such material or advertising for such material.

   3. Warez or Hacking - Includes pirated software, ROMS, emulators, phreaking, hacking, password cracking. IP spoofing, etc., and encrypting of any of the above.

   4. The above also includes any sites which provide "links to" or "how to" information about such material.

   5. .EXE files - no unsolicited executable files can be stored on the servers for security and satiability reason.

   6. Any file that would disrupt the operation of FP World's servers or any other servers. FP World reserves the right to remove your website(s) and cancel your hosting services without notice if we deem that you have violated the Terms of Service at any time.

5. FP World has a ZERO TOLERANCE for SPAM. FP World reserves the right to immediately remove you from our system if you are involved with, or reported as using, SPAM.

6. You understand that at no time will Refunds be issued for hosting services, domain names, etc. You are responsible for any and all time/costs related to hosting and technical support during your contract. If you are making payments, you understand and agree that on the date your payment is due, if your credit card is unable to be charged, we will wait 5 days and re-charge your card with an additional $10 fee. If your card bounces a second time your services will be suspended immediately!

7. There is a significant cost inherent in setting up a hosting presence, emails and domain name, etc. If you cancel and/or otherwise receive a refund for any of the package, your hosting will be immediately cancelled. However, with the exception of the 3 month starter package cancellation and refund policies, cancellation of the Web Success Packages will generate a hosting and services fee of $200 plus 20% per month that the hosting is used. The 20% is that percentage charged of the total Web Success package amount — the $200 and 20%/monthly will be retained from paid totals and/or charged to your card.

8. If you are using the "EZ 2 Buy" payment terms feature, your domain name (if it is part of your package) will be owned by FP World until such time as your final payment is made. We will not release your domain name(s) until all charges are paid in full.

9. We are not responsible for loss of data, etc. Tech Support is free of charge when it is an issue on our end (such as downtime on the server, migration, etc...) However if you require tech support because of a problem that was caused by you, you will be charged an assessment fee of $15.00 (min. charge) - to fix the problem. Additional time will be billed at $70/hour, billed in 30 min. increments.

10. We have posted a "Please Read Terms of Service (T.O.S.)" in several places throughout our websites. Your digital signature when accepting or submitting our forms is considered acknowledgment of these Terms of Service and binding acceptance of same.
